TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACCRETING.COM, ITS OWNER(S), OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, TAX PENALTIES, INVESTMENT LOSSES, GOODWILL, USE, OR DATA.
IN ALL EVENTS, THE AGGREGATE MONETARY LIABILITY OF ACCRETING.COM AND ITS AFFILIATES ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE, TOOLS, CALCULATORS, OR SERVICES SHALL BE STRICTLY LIMITED TO THE GREATER OF:
- (A) ONE THOUSAND U.S. DOLLARS ($1,000.00 USD); OR
- (B) TWO TIMES (2X) THE TOTAL FEES OR OTHER AMOUNTS PAID BY YOU TO ACCRETING.COM OR ANY OF ITS AFFILIATES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
4. Mandatory Individual Arbitration & Discovery Restrictions
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
A. Requirement of Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, calculators, or any services or relationships resulting therefrom shall be determined exclusively by final and binding individual arbitration rather than in court.
B. Governing Jurisdiction & Mandatory Venue: The exclusive jurisdiction and venue for any arbitration proceeding (and for any court proceeding allowed hereunder) shall be in Orlando, Florida.
C. Strict Discovery Limitation in Arbitration: In any arbitration proceeding conducted under these Terms, there shall be no discovery other than the exchange of non-privileged documents directly relevant to the dispute. No depositions, written interrogatories, requests for admission, or other forms of discovery shall be permitted.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ACCRETING.COM HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY AND ALL RIGHTS TO A TRIAL BY JURY IN RESPECT OF ANY ARBITRATION, LITIGATION, LEGAL ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF ACCRETING.COM.
6. Governing Law
These Terms and any disputes or claims arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any choice or conflict of law provision or rule.
7. Advisor Referrals & Third-Party Services
Accreting.com may provide links or referral opportunities to independent fee-only financial advisors or third-party resources. Accreting.com does not manage client accounts, execute security trades, or supervise third-party financial advisors. You acknowledge and agree that Accreting.com is not responsible for any advice, actions, services, or performance provided by third-party professionals.
8. Changes & Modifications
We reserve the right to revise, update, or modify these Terms at any time without prior notice. Your continued use of Accreting.com following the posting of revised Terms constitutes your acceptance of and agreement to the modifications.
